1. Acceptance of Terms

By accessing or using the services provided by AES VC, S.A.P.I. de C.V. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.

Aceptación de Términos: Al acceder o utilizar los servicios proporcionados por AES VC, S.A.P.I. de C.V., usted acepta estar sujeto a estos Términos de Servicio. Si no está de acuerdo con estos términos, no puede acceder ni utilizar nuestros servicios.

2. Description of Services

AES VC provides technology services including but not limited to mobile application development, AI and automation solutions, system integrations, digital platforms, and technology consulting. Specific terms for individual projects or services may be governed by separate agreements.

Descripción de Servicios: AES VC proporciona servicios tecnológicos que incluyen desarrollo de aplicaciones móviles, soluciones de IA y automatización, integraciones de sistemas, plataformas digitales y consultoría tecnológica. Los términos específicos para proyectos individuales pueden regirse por acuerdos separados.

3. Permitted Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Transmit any harmful or malicious code
• Interfere with or disrupt our services or servers
• Attempt to gain unauthorized access to our systems

Uso Permitido: Usted acepta utilizar nuestros servicios solo para fines legales y de acuerdo con estos Términos. Usted acepta no violar leyes aplicables, infringir derechos de propiedad intelectual, transmitir código dañino, interferir con nuestros servicios, o intentar obtener acceso no autorizado a nuestros sistemas.

4. Intellectual Property

All intellectual property rights in our services, including software, designs, content, and trademarks, are owned by or licensed to AES VC. You may not use, copy, or distribute any of our intellectual property without our prior written consent, except as necessary to use our services as intended.

Propiedad Intelectual: Todos los derechos de propiedad intelectual en nuestros servicios son propiedad de o están licenciados a AES VC. No puede usar, copiar o distribuir nuestra propiedad intelectual sin nuestro consentimiento previo por escrito.

6. Disclaimers and Limitation of Liability

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

In no event shall AES VC be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising out of or relating to your use of our services.

Exenciones de Responsabilidad y Limitación de Responsabilidad: Nuestros servicios se proporcionan "tal cual" sin garantías de ningún tipo. En la máxima medida permitida por la ley, renunciamos a todas las garantías. AES VC no será responsable de daños indirectos, incidentales, especiales, consecuentes o punitivos.

7. Indemnification

You agree to indemnify and hold harmless AES VC, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of our services or violation of these Terms.

Indemnización: Usted acepta indemnizar y eximir de responsabilidad a AES VC, sus afiliados y su personal de cualquier reclamo, daño, pérdida, responsabilidad y gasto que surja de su uso de nuestros servicios o violación de estos Términos.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of our services after such changes constitutes acceptance of the modified Terms.

Cambios a los Términos: Nos reservamos el derecho de modificar estos Términos en cualquier momento. Le notificaremos los cambios materiales publicando los Términos actualizados en esta página. 9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mexico, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Mexico.

Ley Aplicable: Estos Términos se regirán e interpretarán de acuerdo con las leyes de México. Cualquier disputa que surja de estos Términos o nuestros servicios estará sujeta a la jurisdicción exclusiva de los tribunales de México.

10. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services will immediately cease.

Terminación: Nos reservamos el derecho de suspender o terminar su acceso a nuestros servicios en cualquier momento, con o sin causa. Al terminar, su derecho a usar nuestros servicios cesará inmediatamente.
